You can get a licence valid upto 6 moinths from the date of H1 receipt notice. You can go to Wayne Rt 23 MVC. I got it myself last year from there.

I am currently awaiting approval for my I-485. My priority date is August 2006 and I completed fingerprinting on Oct. 29th.
I understand the process of allocating green cards based on employment-based category and queuing based on the labor/priority date.
My question is regarding COUNTRY LIMITS. What role do these limits play in the approval process? To be more specific, if the applicant is from a country that has a very low number of GC requests, does the fulfillment of the country limit take precedence over the priority date/EB category or does it succeed the latter?
Please help....Thank you

yes..I was sent inside for 2nd checking (which is common for AP)

Of the 140,000 annual employment-based immigrant visas available, second and third preference categories are allocated 57.2%. If most of the employment based cases filed in July-August 2007 were second and third preferences, it could take approximately ten years of allocation to complete all these cases.
Although USCIS has posted on its website that I-485 cases received on or before August 9, 2007 have been entered into the system, a number of attorneys have not yet received receipt notices for cases filed at the end of June and July 2007. Moreover, some cases initially filed in Nebraska and transferred to Texas have now been forwarded to the Vermont or California Service Centers for faster processing of receipts.
USCIS is making every effort to process EAD applications within 90 days of receipt. The processing of Advance Parole applications may be delayed due to the number of cases filed.
A Biometrics notice will be issued even if a visa number is not available at the time.

Thanks for the reply - that helps.
Another question I had was about LUDs. I did my FP on Oct-29-07 on which date I also noticed an updated LUD (from Sep-25 to OCT-29).
However, on Oct-31, I noticed that the LUD was updated yet again to OCT-30.
Any idea what this could mean?

Is there any specific PERM requirement as to how many days does the job posting need to be posted on a job search website like monster.com?
For some reason, I thought that it was required for the job to be posted for at least 30 days but I can't find out the source.

actually there is, if you do it my way you see an x, y and z level: there you can enter numbers, for example x= 3 and Y=5 and then you will see he will rotate differant.

Facebook Inc. was also ordered to disable ITgrunt's Facebook page.
The order was made in response to a libel lawsuit filed by IT services and consulting firm Apex Technology Group Inc., based in Edison, N.J. against the three Web sites opposing the H-1B visa program (http://www.h1b.biz/lawyer-attorney-1137085.html). Such attacks on H1B supporters increased last year as the economic situation was gloomy, and prospects for employment were not looking good. My sister in India may be getting married to a US citizen..she would like to apply for a tourist visa first so she can come stay in the US and spend some time with him before her marriage.
If she applies for a tourist visa, stays in the US for a month or so and then later they apply together for a fiance/K3 visa, are there going to be problems for the K3 visa application considering that she had just applied for a tourist visa before? Is it better to not apply for the tourist visa in this case? Thanks...

If you ram into US with a B1/B2...then great they will made deal with you...however one thing
be careful about...if the marriage is soon after you enter US and can complain of the false intent in the B2 entry...
Have alook at Fiancee visa (K Visai think so ) as well.

--I have EAD and 485 pending. My current status is H1B. But if I use my EAD without marriage...
--Later I get married and I cannot bring her here, but if I wait until my PD becomes current and at which point of time my spouse can be added to 485, so does my spouse need to maintain a valid non-immigrant status to be added to my 485 since she will be out of US.

You can do Info pass and ask for both. Alternatively, you can try calling USCIS when your priority date is current and ask for this information. If you are lucky, they will tell you whether or not there are any security checks are pending. People noted that there are no LUD when NC gets through. On the other hand, if one has a FP and a couple of days later there is a LUD on I485, that often means FP cleared. Remember that FP and NC are completely separate tasks.

Yes, what is this security clearance? I have applied for H1B renewal after 3 years on July 23rd (my receipt date) of 2007, and this still has not been processed and sent. I was told it has been sent for security clearance. I am here in US working without H1B visa after 7 months of my H1B visa expiry while my renewal is still pending as of today (03/07/08). Does anyone have an idea when is this going to be processed and will I ever get my work visa renewed ?
