You should have asked before filing for an extension or do a search at USCIS Home Page (http://www.uscis.gov) you would have come across the below:

I don't know if you can get the fee back since the extension has been approved. Next time, ask when you are not sure.

if 6 years completed without an LC/I-140, then if someone moves to H4, does LC+I_140 in say 5-6 months, can he/she come back to H1 (3 year extension?)

Why dont you join the MA state chapter for IV and email the group so someone can get in touch with you and perhaps guide you to a good lawyer .

Hi !
Our lawyer had posted our application on July 2nd and we had our fingerprinting scheduled for 21st august which was completed.
I checked my status on the USCIS site for the very first time today. And it says. "On July 30, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case" . Can anyone kindly explain me what this means ( how July 30th and what mail are they talking about ?we never received any! ) ...

Found the old J1 Visa stamped in the passport. It does list the 212(e) requirement.
At the time when I got the first H1, I had 2 years, or close to 2 years of accrued stay in Russia. I should definitely have 2 years by now.
What could be the result of not having had full 2 years at the time of first H1? What could be the effect on the currently active H1?
If I show that right now I have 2 full years, would the AOS proceed, or are there any retroactive problems?

The only benefit of F1 over H4 is you get to use OPT and CPT. Doing an internship may be very beneficial if you are doing a MBA. After that OPT helps you to settle in a job and deal with H1B filing quota risks.
Regarding the downside of F1, many universities don't give instate tuition eligibility to students on F1. On H-4, you may pay instate tuition to many universities. So, check with the university that you are planning to attend.
Also, it will be very difficult to get a F1 visa stamp on your passport if I140 has been filed for you in the past. Its not a problem if you don't want to travel outside the country during your studies.

Hello all, please share your thoughts/advice on my case.
Worked for Employer A from May 2004 - April 2007
I-140 approved for Employer A in January 2007 (EB2 Category)
Changed job in April 2007 to Employer B (my current employer).
I-485 filed in July 2007 using approved I-140 from Employer A, and a letter for future employment.
Employment verification RFE received in June 2009
My lawyer advises to use AC21 and provide employment verification letter from my current employer (Employer B) for this RFE response.
Since my I485 filing was based on future employment and I did not work for Employer A for 180 days after filing I-485, this causes some complexity.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

I have a Q regarding the follow-to-join rule. Say one has filed I-140 and I-485 recently (concurrently filing). To use the follow-to-join rule, can the spouse file I-485 at any time after the primary applicant's I-140 is approved but before I-485 is approved? In that case, will the spouse's I-485 be approved around the same time as the primary applicant?
A related Q, will a Visa number be immediately available after one's I-140 is approved?

I applied for H1b visa transferred in Nov 08 inspite of not having recent pay stubs. After applying transfer, I started working for new employer.
Last week I got query from USCIS asking my latest pay stubs (Oct 08) and yesterday I got Laid off from my new job after working for 4 months (till Feb 09).
My husband is on L1B visa.
In my case
1. Shall I consider transferring to L2? for this do I need to go to my home country (India) for L2 stamp?
2. If COS to L2 is approved, Can I work on my old H1B again if I find an employer who is ready for transfer?
3. If I travel to my home country(India), will my H1B visa be cancelled? as currently i don't have any H1B approval.
4. Whether the Request For Evidence(REF) on my H1B transfer will have any implication on L2 stamping?
