Hi All..
I am on H1 since Oct 07. I haven't left USA so far and so I haven't gone for stamping. However, I heard that I need to go to stamping before completion of 1yr after getting H1. Is this true? and to what cases does this rule apply?
Please help. I am confused.

USCIS Abandons Current Policy of Requirement for Approval of I-485 Cases Pending in Excess of 180 Days from FBI Name Check Request
Adjudicators must obtain definitive FBI fingerprint check and the IBIS check and resolution before they can approve I-485, I-601, I-687, and I-698 applications

This if u sent your packet by US postal mail . Fedex and other courier dont deliver to PO boxes . There is another street address for other courier.
Thanks Milind70 for the reply , yes I did use USPS because the the IO told me to send my 485 package to the address shown on I140 receipt and Fedex does not deliver mail at P.O box. I am wondering if the P.O Box address is right and should i wait for 90 days or call them based on Lockbox receipting update bec as per Aug10th release TSC shows done receipting till June 28th? Is there a way to inquire regarding my application?

Illegals are another story, and now we need to focus on the legals, as all efforts trying to bind legal and illegal together turned out to be failure completely.
While we can keep an eye on these articles - these are coming up to counter our efforts.

I would only say - IV is for legal immigrants, for those who have maintained legal status and have played by the rules.

I have stamped from Canada 3 times before. without any issue.
I do not know the situation today. If you have all the required documents ready
and You attorney has sent a copy of your H1 extension to PIMS office at Kentucky
(For all extension petition this is required) You can stamp at Canadian US consulate
without much issues. If PIMS is not updated then you have to be ready to stay at Canada
for 1 to 3 months. so be careful before taking decisions, especially nowadays.This is my understanding.
Same thing at Indian consulates. I

Here is the situation:
I-485 is pending
H1 Visa will expire on July 31, 2009 (extension is being filled now)
AP is pending for 6 months with no end in sight...
No EAD
Need to travel in end of June for a month:

Can I travel on AP when my H1 petition is pending?? (I do not expect that I will get it before I leave, it took more than 6 months last time). I read in many places that if you apply for H1 petition you cannot leave till it is approved, is that true???

I was working for employer A.I left employer A on Nov 15 , I received my last paycheck from employer on Nov 22, 2007.
I know my employer A did not revoke / cancel my H1b.
I accepted offer from employer B on Nov 20.I came in communication with employer B lawyers on Nov 23.I am based in one state and work
in another state.Lawyer got all the documents from me on Nov 25,Then she said , we will have to get prevailing wages from two states , and she
send the request for them.We received prevailing wages from states on Dec 11.Then she sent my H1b transfer petetion to USCIS on Dec 14.I received
the receipt from USCIS on Dec 18.
Will my H1b get transferred , or will I have any issues.

are there any approvals from TSC lately ? since the online status is down, there is no way to get status updates now. Worse yet we don't get notifications on RFE's and if the lawyer did not notify on time, this is going to be a disaster..

My spouse currently is in H4. Is it possible to get his F1 visa stamped (with i-20 and other documents) within US? for example, in local USCIS offices.?

My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree

sorry to break it to you - but he's quitting a very happy man as every other rupublican is trying to 'out-tancredo tancredo' as he himself put it. he's done his job and poisoned the atmosphere which is all he wanted to do.
I disagree . He thought his immigration stance will take him to white house. He earlier announced that he will not run for congress again. Poison can be taken care of as long as you kill the snake so that it does not bite other people.

Just a question.......... I just got my receipts for my 485. When I checked the receipt number on uscis it says that an approval notice for the ead was sent out 2 days ago. Any idea how long it takes to actually get the card??

I am on H1B visa. My visa expires in April 2010. I was arrested in New York for a misdemeanor charge which was subsequently dismissed by the court. There was no guilty plea etc so under immigration law too I DO NOT have a conviction. I have all the final court docs. I am travelling to India to renew my H1B visa. I have a few questions -
(i) Is there a possibility that I am selected for 221 g screening? How long does the 221 g screen take?
(ii) Since I have a valid visa am I allowed to enter the US while they are completing the process? I have left the country before and entered on my current visa. I was sent for additional screening at the airport but had no issues since I have all the court documents.
Any insights would be appreciated
