Could you all please give me an opinion on this situation? I am trying to ask my lawyer, but I won't know for a few days and this is disturbing me a lot!
I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?
Let your lawyer confirm this: Get your I140 approval, if possible by using premium filing. File for a 3 year H1 extension. After extension, transfer H1 to new employer. Start GC process with new employer but maintaining your PD since your old employer aill not revoke your I140.

You may as well ask uscis to ask for the remainder of the H1B period provided there is an employer who is willing to process your H1B. Remember, you will have to lose your current I485 processing and start all the way from scratch though you can recapture the priority date with the new GC process.

maybe make the colours a bit nicer? and add a price aswell... makes it look a lot more like a stamp.

hi everyone,
i wondered if someone could help me find answer to the following questions.
I am a Physician and currently in Residency program which is for 3 years. my residency ends on 30th September 2008 and i have H1b status. I have been offered Fellowship in my desired specialty but it starts on 1st January 2009, therfore there is a gap of 3 months between the end of my current job and beginning of my next job.
so my questions are:
1. H1 petition which I will file for my fellowship starting 1st jan 2009 would be an extension of my current H1 or would I have to file a new H1?
2. suppose I find a job for 3 months gap period at the same institution where I have got my fellowship (keeping in mind that decription of this job would be a little different from what i will be starting from 1st jan 2009), would i have to file for 2 different H1B petitions (one for 3 month period starting 1st oct 2008 and the other for fellowship starting 1 st jan 2009).
3.also, I was thinking that if I file for H1 approval say in july 2008 for the fellowship starting 1st jan 2009 and get approval by mid september 2008. with the approved petition I go back to India and have a vacation for 3 months and come back to US in late december 2008 on H1B again for Fellowship beginning 1st jan 2009. In this case, what would be my status for the gap period of 3 months that I spent in India?
also, would I be issued a new SSN when i come back again. also, i have heard rumors that US embassy in Delhi can hassle you to get H1. How true is that?

I hope this is a winner, I really liked Minolta cause they ALWAYs gave the most camera at the best price. And their film cameras always screamed of class!
Lets hope this camera can live up to my expectations, I just don't know how that image stabilization will work.

We had a 8 hr long meeting with a lobbying firm right on the Capitol hill. The meeting progressed very well. We came out with a wealth of information. This firm seems to have the right contacts and connections. I am creating a pointwise document the people in this firm promised and were confident to achieve. Just to let you know we have Labor Backlog centers and Retrogression on our agenda.

Hi,
I have received the EAD card yesterday with No finger prints available. But we have done our Finger printing before the EAD is approved. Approx 4 weeks before.
Is this normal? Or i should contact USCIS about this?
I know some applicants getting their EAD cards before finger prints were taken for them No finger prints available makes sense.
Any responses are appreciated

I'm with Michael on the lizard shot ... maybe it's the disconnected rear foot that makes it look odd.
I REALLY like the water lily shot, Josh. The composition is beautiful, with the other lily pads forming a "circle of circles" counterbalance to the flower. Very, very nice ... in fact, probably my favorite of all your posted photos. (not that I have anything against the others)

My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?

I applied my labor as Software Engineer and BEC approved it with a code of Mechanical Engineer. I got it changed, but took me a year though. They kept my change request until the end when they were ready to shutdown BEC.
I probably go ahead and use what in the approved labor certificate. by the way how do I find exact job-code that I used in the I-140.

Honesty is almost always the best option.... here would be my answers:
1. I came to US for work and have found US to offer challenging work environment full of opportunities. After working for 6 years, I would like to upgrade my skillset and hence, the decision to go for education
2. In this global economy, it is hard to plan exact details, but I believe that with my US experience and added education, I should find a rewarding position anywhere in the world
3. I've attached the papers of my home in Pakistan where I intend to return in the long run, but most probably I'll have to move to the place where I'm offered the job after my education
Of course, there is no gurantee that the USCIS will respond positively to honesty, but at least your friend's conscious will always be clear.... good luck to her!

My sister in India may be getting married to a US citizen..she would like to apply for a tourist visa first so she can come stay in the US and spend some time with him before her marriage.
If she applies for a tourist visa, stays in the US for a month or so and then later they apply together for a fiance/K3 visa, are there going to be problems for the K3 visa application considering that she had just applied for a tourist visa before? Is it better to not apply for the tourist visa in this case? Thanks...
